New York Education Law Compliance

Article 129-A
Written Rules and Policies
General Provisions:
- In compliance with NY 129-A, § 6430, SVA maintains the Rules for the Maintenance of Public Order. This set of policies is included in the SVA Handbook.
- SVA annually files with the NYS Department of Education on or before the first day of July a certificate of compliance with the provisions of 129 A & B
Advisory Committee on Campus Security:
- In compliance with NY 129-A, § 6431, the Advisory Committee on Campus Security reviews current campus security policies and procedures and make recommendations for their improvement.
Sexual assault, domestic violence and stalking prevention information:
- In compliance with NY 129-A, § 6432, SVA maintains information on its Sexual Misconduct Policy & Resources page regarding preventing sexual violence as follows:
- Policy Against Sex-Based Discrimination, Harassment, and Sexual Misconduct
- Resources for the SVA community
- Training for all members of the SVA community including:
- Online learning for all new students
- Online learning for all employees including administrative staff and faculty
- Live training courses (via Zoom and In-person) for all first responders
- Live training courses (via Zoom and in-person) for all administrative roles in the Title IX process
Campus crime reporting and statistics:
- In compliance with NY 129-A, § 6433, as well as the Clery Act, SVA maintains information regarding campus crime reporting by filing the annual Campus Security Report with the US Department of Education.

Investigation of crimes and crime reporting:
- In compliance with NY 129-A, §6434, SVA maintains policies regarding procedures for:
- Missing students
- Violent felony offenses
- These policies can be found in the SVA Handbook
Bias related and hate crime prevention information:
- In compliance with NY 129-A, §6436, SVA maintains policies regarding procedures for bias incidents and hate crimes, in the SVA Handbook
- Information regarding prevention of these type of incidents is included in online training prior to students starting at SVA as well as during orientation programming.
Prohibition on the marketing of credit cards:
- In compliance with NY 129-A, §6437, SVA prohibits the advertising, marketing, or merchandising of credit cards on campus. This policy is also included in the SVA Handbook.
Notification of fire safety standards and measures in all college-owned or college-operated housing:
- In compliance with NY 129-A, §6438, SVA provides information regarding fire safety standards and measures in all SVA housing facilities. This information can be found in the SVA Handbook.
- Educational information is provided to all campus housing residents by the Residence Life Department including programming and educational flyers and materials regarding safe cooking and other fire safety measures for the community.
Article 129-B
Written Rules and Policies
Affirmative consent to sexual activity, Policy for alcohol and/or drug use amnesty, Students’ bill of rights (code of conduct), and Transcript notations:
In compliance with NY 129-B, §6441, §6442, §6443, §6444, SVA has adopted these policies as outlined in the statute. These policies are available in the Policy Against Sex-Based Discrimination, Harassment, and Sexual Misconduct.
